Wow, this is a great and heavily disturbing article. It brings to mind concerns that I think are becoming shared by a number of different groups, centralizing the cause and underlying issues.

One such issue that many groups complain about is the expertise - or lack thereof - many of the administrative staff have to make decisions in specific instances. As many administrators that hold these jobs don't in fact have expertise in the field they are regulating, their decisions are very easily manipulated by those that do (ie, DOD, DOE, EEOC, NSF, etc.).

I agree. From what I hear, some of the proposed deals made before the November announcement that NHL would not play in December, sounded extremely reasonable. The main fight seems to be around the percentage players and NHL will get from attendance.

This is interesting and somewhat frightening. Wouldn't it allow law enforcement agencies to use network usage in the same way many large employers/copyright holders can?

Many such employers almost never enforce their contracts preventing employees from checking social networks, reading email, or surfing the web as almost all employees do at some point. When they want to fire someone for other reasons (personal or otherwise), it creates a very easy way to fire someone without benefits (IMHO).

Copyright holders like the RCAA sue people for tens of thousands of dollars for downloading single records, even though they aren't suing 99.99% of the other people that do it much more often.

Similarly, won't this allow law enforcement agencies to start convicting people of doing things they don't even realize are illegal because they can't find evidence for other crimes?

There are several problems with Facebook keeping data for so long and to such extent.

1. While Facebook states that the information belongs to the User, it also states that the User allows Facebook to use the information

2. As an user you can download all of your data. That means it is discoverable in a lawsuit. So ALL of that data, is kept until you delete your account. And all of the rants/vents, pictures, opposing counsel might have access to in a legal process (assuming it is relevant, etc).

3. Facebook provides in its Privacy Terms that they use the data for many purposes, including:
            (a) to see how effective their ads are for you and others; and
            (b) for internal operations (such as troubleshooting, data analysis, testing, research, and service improvement)

The worrying thing is, what are they going to do with all the data? Will it be analysed and sold? I am one of the small number of people who don't have a Facebook account -- by the looks of it, I'll never have one.
