Court Dismissed FLSA Claim v. Tribal Casino on SMJ Ground

Larimer v. Konocti Vista Casino Resort, Marina & RV Park (N.D. Cal.), in which the court dismissed plaintiff’s FLSA overtime case against a casino corporation owned and operated by a Native American tribe.  The basis of the dismissal was that under the doctrine of tribal sovereign immunity, the court lacked subject matter jurisdiction over the defendant.
